Vinge has extensive experience with financial restructuring and in handling insolvencies. We advise borrowers, lenders and other parties interested in restructuring. We also act as bankruptcy trustees, business restructurers, and liquidators. Vinge handled several of the largest bankruptcies and insolvencies that have taken place in Sweden. During the property and banking crisis of the early 1990s and during the IT crisis at the beginning of this century, we played a central role as advisers to diverse party interests.
An impending bankruptcy can be avoided in many instances through proactive measures and negotiated solutions, which is why the focus has been shifting more and more to these types of actions. Owners and creditors often have a common interest in protecting the assets that are still found in the distressed company. Vinge’s vast skills and capacity in mergers & acquisitions, labour law and bank & finance, combined with our insolvency expertise, gives us a unique capability to carry out extensive and complex reconstructions. A major restructuring is by its nature a complex transaction that may involve renegotiations of loan terms, staff cutbacks and infusion of new capital in the form of different types of loans and equity as well as transfer of assets. We represent diverse interests in reconstructions, such as owners, borrowers, lenders and purchasers of assets. The underlying insolvency, or risk of insolvency, places special demands on those advising these diverse interests.
Our activities also include assistance in legal processes and arbitration proceedings in insolvency matters together with advice to owners, management and boards of directors in companies that are experiencing capital shortages and possibly facing insolvency.
